Content Takedown Policy

1. Child Sexual Abuse Material (CSAM)
How to report CSAM:
- Email [email protected] with subject:
[URGENT-CSAM] - Include: description of the content, where you saw it (chat, Flash Card, room), approximate timestamp, any device/user identifiers visible
- You can also report directly to NCMEC: report.cybertip.org
Our obligations: Under 18 U.S.C. §2258A (USA) and IT Act Section 67B (India), FlashChat will report confirmed CSAM to NCMEC CyberTipline and cooperate fully with law enforcement investigations.
2. Copyright / DMCA Takedown
If you believe your copyrighted work has been shared on FlashChat without authorization, you may submit a DMCA takedown notice.
DMCA Notice Requirements
Your notice must include:
- Your full legal name and contact information (email, phone, address)
- Identification of the copyrighted work you claim is infringed
- Identification of the infringing content on FlashChat (Flash Card ID, URL, room name, or description)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature

Response time: We will process valid DMCA notices within 48 hours.
3. Government and Court Orders
FlashChat will comply with valid government orders and court orders for content removal in accordance with applicable law.
- India IT Act Section 69A orders: Content will be removed within 36 hours of receiving a valid blocking order from an authorized government agency.
- Court orders: Content will be removed as directed by the court within the timeframe specified in the order, or within 36 hours if no timeframe is specified.

4. General Content Removal
Any user can request removal of content that violates our Terms of Service. This includes but is not limited to:
- Harassment, threats, or targeted abuse
- Non-consensual intimate imagery
- Doxxing or sharing of personal information
- Terrorism or extremist content
- Spam or commercial solicitation
- Content that violates applicable law
How to request removal: Email [email protected] with subject: [REMOVAL] Brief description. Include the content location (Flash Card ID, room name, or description) and the reason for removal.
5. Response Timelines

6. Counter-Notice (DMCA)
If your content was removed pursuant to a DMCA notice and you believe this was done in error, you may submit a counter-notice to [email protected] with subject: [DMCA COUNTER-NOTICE]. Your counter-notice must include:
- Your full legal name and contact information
- Identification of the content that was removed
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Consent to the jurisdiction of the courts in your district
- Your physical or electronic signature
Upon receiving a valid counter-notice, we will forward it to the original complainant and restore the content within 10-14 business days unless the complainant files a court action.
7. Data Preservation
When content is removed for legal reasons (CSAM, court orders, law enforcement), we preserve a record of the removed content, associated device identifiers, timestamps, and available metadata for the following periods:
- CSAM reports: 1 year (per 18 U.S.C. §2258A preservation requirements)
- Law enforcement / court orders: As directed by the order, or 1 year by default
- General content removal: 90 days
